Founding and Co-Managing Partner Sheryl Leichenger, Partner Kristina Fretwell, and Associate Vinnie Patel recently secured summary judgment for a national specialty insurer in an equitable contribution dispute in the U.S. District Court for the Central District of California.
The Court denied the opposing insurer’s motion and granted the firm’s client’s motion in full, agreeing that the other carrier’s policy was primary and covered the underlying claim.
In its ruling, the Court determined that the two insurers did not share the same level of liability on the same risk. As a result, the Court held that no basis existed for equitable contribution and entered judgment in favor of the firm’s client on every cause of action.
The matter was handled by Sheryl Leichenger, Kristina Fretwell, and Vinnie Patel.
