Selman Team Obtains 12-0 Defense Verdict
Selman congratulates Mark Love and his team on successfully defending a shopping center in a case of alleged groundwater contamination by one of its tenants. Mark and his team argued that the pollution could be remediated and therefore only the loss of use and clean-up costs were compensable and that there was zero decrease in property value. After a six-week trial, the jury rendered a 12-0 verdict in favor of Selman’s client: no negligence and no causation. The jury also found that plaintiff had suffered no damages.
