Selman Partner Peter Mintzer Discusses Impact of PFAS Litigation during 2022 EECM Conference
Selman partner Peter Mintzer addresses how ongoing PFAS litigation will continue to impact the future of insurance policies and other funding sources being asked to cover costs associated with defense, replacement drinking water/treatment, remediation and natural resource damages. His fellow panelists include Robin Kelliher, Senior VP of Willis Towers Watson, and Jeff Andrilenas, Executive VP and Environmental Lead at TBLS Group.
“It is very important for insurers to understand the true scope of liabilities associated with impending PFAS litigation and coverage issues they face in light of the increasing focus from the EPA and the States on certain PFA-containing chemicals used in fire-fighting foams and thousands of other industrial and consumer products,” said Mintzer, Managing Partner of the firm’s Pacific Northwest Group.
The panel of insurance, legal, and technical practitioners will provide a PFAS regulatory and case ruling update, a technical overview of trending best practices used by the DOD and regulators for determining whether costs are “probable and estimable and if so, how much,” and an analysis of how insured defendants are tapping into a variety of past and current CGL, PLL and other policies to cover costs associated with these emerging contaminants.
