CLM Magazine Publishes Article by Mark Inbody and Savannah Montanez on "Pushing Limits"

An article co-written by Selman Breitman Partner Mark E. Inbody and Associate Savannah R. Montanez appears in the February 2020 edition of CLM Magazine.

Pushing the Limits: Six Steps for Responding to Pro-Forma Time-Limit Demands, discusses the use of policy-limits demands with a short time limit for acceptance to pressure insurers to settle cases of questionable damages.  Mark and Savannah discuss how this tactic benefits claimants, and how courts have responded. They then explain that that counsel for an insurer has more options under these circumstances than just "pay or deny."  In an in-depth discussion of counsel's obligations, the article provides a practical roadmap to help navigate this increasingly common demand.

Savannah and Mark are members of the firm's Insurance team in San Francisco. Mark also handles Commercial Litigation and Construction matters. He has been responsible for several opinions before state and federal courts, and is often called upon to conduct certified training in compliance with the California Fair Claims Handling Act. He has published numerous articles, and served as a contributor to the most recent editions of the Matthew Bender Practice Guide: California Insurance Coverage and Litigation.
