Jerry Popovich And Selman Breitman's Orange County Office Obtain Another Favorable Verdict
Jerry Popovich has led the Orange County trial team to another favorable verdict--this time on behalf of a national rental car corporation.
Plaintiff was standing on the rental agency's shuttle bus during the ride from the car-return facility to the airport and was hurt when the driver had to brake hard for a car turning left at an intersection. Plaintiff was thrown to the bus floor in the event, injuring the ulnar nerve in her left elbow. She claimed pain and tingling symptoms for more than three years, despite two elbow surgeries. There was a dispute between the parties about whether the bus driver was entering the intersection on a yellow or red light.
Before trial, and after plaintiff's doctor recommended a third surgery, the demand was more than doubled by plaintiff's counsel. At trial, plaintiff's counsel asked the jury to award over $2 million in general damages and $60,000 in (undisputed) economic damages. While the jury found in favor of the plaintiff, the award was substantially below plaintiff's demand. Economic damages were awarded at $61,795 and gross noneconomic damages were awarded at $137,500. The fault was apportioned 55% to the rental agency and its driver, with 45% to the left-turning car. The net verdict is $199,295, or about 40% of the lowest the case could have been settled for pre-verdict.
